Welcome to Tingley House Creative. The terms “we”, “us”, and “our” refer to Tingley House Creative. We operate this store and website, including related content, features, tools, products, and services (the “Services”). Our store is powered by Shopify.
By visiting or using the Services, you agree to these Terms of Service (“Terms”) and to our [Privacy Policy]({{ shop.policy_privacy_url }}). If you do not agree, do not use the Services.
1. Eligibility; Accounts
You represent you are at least the age of majority in your state or province. You are responsible for your account credentials and all activity under your account. Provide accurate, current information and keep it updated.
2. Products and Content
We try to display products accurately, but colors and appearance may vary by device. Descriptions, pricing, and availability can change without notice. We may limit quantities or discontinue items at any time.
3. Orders; Cancellations; Returns
Your order is an offer to buy. We may accept or decline any order. We must receive and process payment before acceptance. If we change or cancel an order, we’ll attempt to notify you using the contact details provided at checkout.

4. Prices, Taxes, Promotions, and Billing
Prices can change without notice. Posted prices exclude taxes, shipping, handling, and (for international orders) duties or import fees unless stated. You authorize us and our payment processors to charge your selected payment method. Promotions and coupon codes: one per order unless we state otherwise; they may have separate terms that govern in case of conflict. We may correct pricing or other errors and cancel or refund orders placed at an incorrect price.
5. Shipping, Delivery, and Risk of Loss
Delivery times are estimates, not guarantees. We are not responsible for delays caused by carriers, customs, or events beyond our control. Title and risk of loss pass to you when we hand the order to the carrier.

6. Intellectual Property and License
All content in the Services—trademarks, text, images, graphics, video, audio, software, and the design and selection thereof—is owned by us or our licensors and protected by law. We grant you a limited, revocable, non-transferable license to access and use the Services for personal, non-commercial purposes. No other rights are granted.

We may provide access to third-party tools or integrations (for example, payment providers, reviews, analytics, marketing, shipping). These are provided “as is” and “as available.” Your use is at your discretion and subject to the third party’s terms. We are not responsible for third-party tools.

9. Relationship with Shopify
Tingley House Creative is powered by Shopify. Sales are between you and Tingley House Creative. Shopify is not a party to your transactions and is not responsible for any claims related to your purchases. You expressly release Shopify and its affiliates from such claims.

11. User Content; Reviews; Feedback
If you submit reviews, photos, comments, ideas, or other content (“User Content”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, host, reproduce, modify, publish, and display that content in any media for operating and promoting the Services. You represent you own or have rights to your User Content and that it is accurate, lawful, and non-infringing. We may moderate or remove User Content at our discretion.

Our total liability for any claim will not exceed the greater of 100 dollars (USD $100) or the amount you paid to us for the product(s) giving rise to the claim in the 12 months preceding the event.

You agree to indemnify and hold harmless Tingley House Creative, Shopify, and their affiliates, officers, employees, agents, and service providers from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your misuse of the Services.

We may suspend or terminate your access at any time. Sections that by their nature should survive termination do so, including ownership, disclaimers, limitations of liability, indemnification, and governing law.

You may not assign these Terms without our prior written consent. We may assign or transfer these Terms without restriction.
19. Governing Law; Venue
These Terms and any disputes will be governed by the laws of the State of Georgia, without regard to conflict-of-laws rules. You consent to exclusive jurisdiction and venue in the state and federal courts located in Cobb County, Georgia.
20. Changes to the Services or Terms
We may update the Services and these Terms from time to time. We will post changes here and update the “Last updated” date. Material changes will be notified as required by law. Your continued use after changes means you accept the updated Terms.
